Terms of Service

Effective date: August 16, 2026

1. Acceptance of Terms

By accessing or using ProjectCheckin (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

The Service is operated by ProjectCheckin (“we,” “us,” or “our”). These Terms apply to all users, including visitors, waitlist members, and paying subscribers.

2. Description of Service

ProjectCheckin is a web-based platform that allows contractors and field service businesses to document completed jobs through check-ins and automatically generate publicly visible job pages intended to improve their online presence and local search visibility.

We reserve the right to modify, suspend, or discontinue the Service at any time with reasonable notice.

3. Accounts

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
  • You must notify us immediately at support@projectcheckin.com if you believe your account has been compromised.
  • You must be at least 18 years old to create an account.
  • One account per business. You may not create multiple accounts to circumvent limitations or policies.

4. Acceptable Use

You agree not to use the Service to:

  • Submit false, misleading, or fraudulent job information.
  • Upload content that infringes the intellectual property rights of others.
  • Upload photos or content that you do not have the right to share (including photos of private property without permission).
  • Upload, publish, or share private personal information belonging to any third party, including homeowner names, addresses, contact details, or financial information.
  • Upload photographs of documents containing third-party personal or financial information, including invoices, purchase orders, work orders, delivery receipts, contracts, or billing records.
  • Upload or publish inappropriate, obscene, sexually explicit, violent, discriminatory, or otherwise objectionable images or content.
  • Use content generated by our AI features for any purpose other than its intended use within the Service.
  • Violate any applicable law or regulation.
  • Attempt to gain unauthorized access to any part of the Service or its infrastructure.
  • Use automated tools to scrape, crawl, or extract data from the Service without our written permission.
  • Transmit spam, malware, or other harmful content.

We reserve the right to suspend or terminate accounts that violate these terms.

5. Your Content

You retain ownership of all content you submit to the Service, including job descriptions, photos, and business information (“Your Content”).

By submitting content to the Service, you grant us a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute Your Content solely for the purpose of operating and providing the Service — including publishing public job pages on your behalf.

You represent and warrant that:

  • You have the right to submit all content you provide.
  • Your content does not violate any applicable law or these Terms.
  • Your content does not infringe the intellectual property or privacy rights of any third party.

We do not claim ownership of Your Content. You may request removal of your content or account at any time by contacting us at support@projectcheckin.com.

You are solely responsible for all content you choose to publish publicly through the Service. ProjectCheckin is a publishing platform, not a publisher. We do not review content before publication and are not responsible for the accuracy, legality, or appropriateness of content you choose to make publicly visible.

You are responsible for what appears in the photos you upload. Photos you submit may be published on public job pages, transmitted to our AI provider for analysis if you use an AI feature, and published to your own website if you have connected one. You agree not to upload photographs containing the private information of third parties — including customer names, addresses, phone numbers, financial data, pricing, or any visible document such as an invoice, work order, purchase order, or contract. You bear sole responsibility and risk for any such information you choose to upload, and for any consequence of it being processed or published.

We do not review photographs for personal information before they are processed or published, and we have no obligation to do so.

We may use automated tools to screen content for inappropriate material before or after publication. When content is flagged, we may notify you and require its removal. We are not obligated to pre-screen content, and we reserve the right to remove any content that violates these Terms at our discretion.

Copyright complaints. If you believe content on the Service infringes your copyright, send a written notice to support@projectcheckin.com including: (a) identification of the copyrighted work; (b) identification of the allegedly infringing content and its URL; (c) your contact information; (d) a statement that you have a good faith belief the use is not authorized by the copyright owner, its agent, or the law; and (e) your physical or electronic signature. We will respond promptly to valid notices and may remove the content in question.

6. AI Features and Generated Content

ProjectCheckin uses artificial intelligence to help generate job descriptions and other content based on the job details and photos you provide (“AI-Generated Content”). You are responsible for reviewing all AI-Generated Content before publishing it. We make no warranty that AI-Generated Content is accurate, complete, or free from error. You must not publish AI-Generated Content containing inaccurate product information, pricing, or any third-party information you cannot independently verify.

When you use an AI feature, the relevant job details and job photos are transmitted to our third-party AI provider (OpenAI) for analysis. This happens only when you actively choose to use an AI feature. If a photograph you upload contains personal, financial, or document information, that information is transmitted as part of the photo, and you are responsible for that choice. OpenAI's handling of transmitted data is governed by OpenAI's API data usage policies; as of the effective date of these Terms, data submitted through their API is not used to train their models. We do not sell your content, and we do not use your job photos or descriptions to train any model of our own.

7. Publishing to Your Own Website (Titan plan)

The Titan plan includes optional features that publish your job content directly to a website you own and control. These features only operate after you connect your site, and they remain active only while your subscription is active on the Titan plan.

You authorize access by providing credentials for your own site, such as a WordPress Application Password. We store those credentials in encrypted form and use them solely to publish and manage the content described in this section. You may revoke access at any time, either from within the Service or by deleting the credentials in your own site's settings. Revoking access stops future publishing but does not by itself remove content that has already been published.

Depending on how you configure the feature, we may:

  • Create new pages or posts on your site — one for each published job, including uploaded photos, categories, tags, and structured data.
  • Add content to a page you already have — where you place a pair of marker comments on an existing page, we insert a block of your recent job content between those markers.

When adding content to an existing page, we only read and rewrite the content between your markers. We do not modify, reorder, or delete any other content on that page, and we never delete the page itself. If no marker is found, the content block is added to the end of that page's content. If we detect that a page was built with a page builder that stores content outside standard fields, we will not attempt to modify that page and will instead create a new post for that location.

If you downgrade from Titan or cancel your subscription:

  • All pages and posts we created on your site through this feature, including photos we uploaded to your media library, are automatically and permanently removed from your site. Your site may not provide a recoverable trash state for uploaded media, so this removal cannot be undone by us.
  • Any content blocks we added to pages you already had are cleared. Those pages, your markers, and all of your own content on them remain untouched.
  • Your underlying job data is never deleted from ProjectCheckin.
  • If you resubscribe to the Titan plan, previously published content is automatically restored, regardless of how long your subscription was inactive. Jobs that were never published to your site while your subscription was active are not published retroactively on resubscription.

You are responsible for your own website, including its hosting, availability, backups, themes, plugins, and any conflicts between them and the content we publish. You confirm that you have the authority to publish content to any site you connect. We do not warrant that published content will display in any particular way within your site's design, or that it will produce any particular search engine result. Section 11 (Disclaimer of Warranties) and Section 12 (Limitation of Liability) apply in full to these features.

Content published to your site may be crawled, cached, indexed, or copied by search engines and other third parties. Removal of content from your site — whether by us, by you, or as a result of leaving the Titan plan — does not remove copies held by third parties, and we cannot control or reverse that.

8. Subscriptions and Payment

  • Paid features of the Service require a subscription. Subscription fees are billed in advance on a monthly basis.
  • All payments are processed by Stripe. By subscribing, you agree to Stripe's terms of service.
  • Founding member pricing, where offered, is locked in at the rate at the time of your subscription and does not increase as long as the subscription remains active.
  • You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused time except where required by our guarantee (see Section 9).
  • We reserve the right to change subscription pricing with 30 days' advance notice. Founding member rates are exempt from price increases as described above.

9. Results Guarantee

We offer a 90-day results guarantee on eligible paid plans under the following conditions:

  • You must complete at least 3 job check-ins per week for 90 consecutive days.
  • Your dashboard must not show measurable traffic activity (page views, phone taps, or website clicks) as recorded by our platform.
  • To claim the guarantee, email us at support@projectcheckin.com within 30 days of completing the 90-day period.
  • We will verify your check-in activity using platform data. If the conditions are met, we will refund your last 2 months of subscription fees.

The guarantee applies to platform-measured outcomes only and does not guarantee specific business results such as revenue or new customers.

10. Intellectual Property

The ProjectCheckin name, logo, software, and all associated intellectual property are owned by us or our licensors. Nothing in these Terms grants you a right to use our trademarks, trade names, or branding without our prior written consent.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant any specific results from use of the Service.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PROJECTCHECKIN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE CLAIM, OR (B) $100.

13. Indemnification

You agree to indemnify, defend, and hold harmless ProjectCheckin from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, Your Content, or your violation of these Terms.

14. Governing Law

These Terms are governed by the laws of the State of Tennessee, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts located in Tennessee.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the effective date at the top of this page. If changes are material, we will notify you by email or by a notice on our website. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.

16. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion, with or without notice. Upon termination, your right to use the Service ceases immediately. Sections 5, 6, 7, 10, 11, 12, 13, and 14 survive termination.
